These Terms of Service (“Terms”) govern your access to and use of fianu.io and its pages (the “Site”), operated by Fianu Labs, Inc. (“Fianu,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. The Site and Our Services

The Site provides information about Fianu and its continuous governance platform. Access to the Fianu platform itself (the “Services”) is provided under a separate written agreement between Fianu and the customer. If you use the Services under such an agreement, that agreement governs your use of the Services and prevails over these Terms where they conflict.

2. Use of the Site

You may use the Site for lawful purposes and in line with these Terms. You agree not to:

• Use the Site in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems.
• Interfere with or disrupt the Site, including by introducing malware or placing an unreasonable load on its infrastructure.
• Use automated means to scrape, copy, or collect content from the Site, except as permitted by our robots.txt file or with our written permission.
• Copy, modify, or distribute the Site’s content except as these Terms allow.

To report a security vulnerability, please follow our Vulnerability Management Policy rather than testing the Site without permission.

3. Intellectual Property

The Site and its content, including text, graphics, logos, images, animations, and software, are owned by Fianu or its licensors and are protected by intellectual property laws. Fianu, the Fianu logo, and related names are trademarks of Fianu Labs, Inc. Other names and logos shown on the Site belong to their respective owners.

You may view and print pages from the Site for your own informational, non-commercial use. No other license is granted to you by these Terms.

4. Information You Submit

When you request a demo, contact us, or otherwise send us information through the Site, you confirm that the information is accurate and that you have the right to share it. We handle personal information as described in our Privacy Policy and Cookie Policy.

If you send us feedback or suggestions, we may use them without any obligation to you.

5. Third-Party Links and Services

The Site may link to or embed third-party websites and services, such as our documentation, our scheduling provider, and social media. We do not control these third parties and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms.

6. Disclaimers

The Site and its content are provided “as is” and “as available” for general information only. To the fullest extent permitted by law, Fianu disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current. Figures, examples, and product descriptions on the Site are illustrative and do not form part of any agreement for the Services.

7. Limitation of Liability

To the fullest extent permitted by law, Fianu and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site. Fianu’s total liability for any claim arising out of or related to the Site will not exceed one hundred U.S. dollars (US$100).

8. Indemnification

You agree to indemnify and hold harmless Fianu and its affiliates from any claims, damages, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of law rules. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Maryland, and you consent to the jurisdiction of those courts.

10. Changes to These Terms

We may update these Terms from time to time. The date at the top of this page shows when they were last updated. Your continued use of the Site after a change means you accept the updated Terms.

11. General

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and Fianu regarding the Site.
